As far as I'm concerned, you've just listed a number of instances of
ignoring the Constitution, that should more rationally have resulted
in impeachment and removal from office of those who attempted them.
The War Powers Act _could_ have been a rational attempt to draw a
dividing line between warfare and non-serious military actions that
shouldn't require Congressional approval, but as drafted has holes in it
a regiment wide.
Anyhow, getting back to the original topic, I have no problem with
fairly harsh treatment of foreigners who are found to be here illegally.
They should be, if deemed necessary, grilled closely. If suspected of
criminal acts, they should be charged on the public record, tried on the
public record, and imprisoned or deported at our option -- and those who
have no other crime other than violating their visas (if any) should be
deported ASAP after being interrogated. Don't want to get shipped to
Syria? Fine, obey the terms of your visa.
What I was and am objecting to is development of an apparently large,
secret Federal apparatus for putting unspecified people on ice with
all details denied to the public. The jailers allege that those details
would leak valuable intelligence? Fine, give summary information such
as total numbers and average length of incarceration today, with
mandatory release of full details after six months for each prisoner.
