You know, a man once went to jail for saying that the draft was a form
of slavery:
Schenck v. U.S., 249 U.S. 47 (1919)
http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=search&court=US&case=/us/249/47.html
Apparently, the Supreme Court felt that, because it had rejected that
argument the year before,
Arver v. U.S., The Selective Draft Law Cases, 245 U.S. 366 (1918)
http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?court=us&vol=245&invol=366
there was no reason that it should continue to permit the claim to be
re-iterated in public.
